VALIDATION MEANS THAT ATC will make reasonable efforts to contact the winners, obtain verification that the winners are eligible to win the prizes under these terms and conditions, and finally, to obtain all of the appropriate disclosures, releases and delivery information so that ATC can properly deliver the case prizes to the winners.
Users will be notified by ATC staff that they have won a cash prize in the following manner: A Validation Agent from ATC will make reasonable attempts to contact each winner by placing telephone calls and sending emails to the winner. A maximum of three (3) telephone calls will be placed to each winner by telephone. The Validator will leave a voicemail after several unsuccessful attempts to reach the user. It is the user's responsibility to contact the company's designated confirmation phone line within ten (10) calendar days in order to verify user's email and general contact information. In the event that the company cannot verify the user's email and general contact information, the award will be voided.
Once contact is made with the Winner, the Validator will ask the Winner to provide ATC with certain documents and information including: (A) a signed release; (B) a photo; and confirmation that the email address and general contact information is correct. The Validator will send the Winner a blank form of the Release which is officially called the "Affidavit of Eligibility and Release of Liability for Participation and Publicity". The Winner is required to complete the form, sign it, and return it to the Validator at the address, fax number or email address provided to the Winner by the Validator. The form should be sent together with a recent photograph of the Winner Winners may be required by ATC to participate in a photo, video and/or film session and acknowledge that ATC has the right to use such publicity photos, videos and/or films in any medium and in any reasonable manner it sees fit, unless that person advises ATC at the time of entering the relevant sweepstakes that he/she wishes to retain his/her anonymity. Copyright in any such material becomes and remains the sole property of ATC. ATC may publicize, broadcast or otherwise disclose a contestant/participant's name, character, likeness, statements or any recording of their voice in advertising or promotional activities concerning a specific sweepstakes, or ATC sweepstakes generally. ATC may promote or advertise that a winner has won a sweepstakes. Except where legally prohibited, acceptance of any prize constitutes permission for Sponsors to use the Participant's name, photograph, likeness, voice, address (city and state only - not street address) and testimonials, in printed, broadcast media or new media, in perpetuity, in any manner they deem appropriate in connection with promoting this or any other Sweepstakes or promotion sponsored by them, without further compensation in connection with this Sweepstakes or the prize awarded.
Winners who refuse to participate in the validation process or who cannot belocated for any reason: forfeiture: If a Winner cannot be located after reasonable attempts have been made to contact the winner, then that person's winning status has not been validated and the cash prize is forfeited. In the event that a winner chooses not to accept a prize, then that person's winning status has not been validated and the Winner forfeits all claims to that prize. In the event a Winner refuses to provide ATC with the signed release form, the photograph of him or herself; or refuses to confirm the email address or the contact information, then that person's winning status has not been validated and the cash prize is forfeited. All forfeited cash prizes are returned to ATC. ATC may use the money for any purpose it deems appropriate including the payment of future prizes for future monthly sweepstakes.
What happens when a winner properly validates their winning status, but the envelope containing the check is returned as non-deliverable by the post office or courier service? Non-Deliverable Prizes: ATC may, at its discretion, utilize an outside third party professional mailer company to ensure proper delivery of all Cash Prizes. The Cash Prizes are mailed directly to the address provided to us by User. If the envelope enclosing your cash prize is returned to us as non-deliverable by the U.S. Post Office for any reason, ATC will check to make sure the envelope contains the correct address as provided by User. If it does not contain the correct address as provided to us by you, then the envelope will be readdressed and mailed back to User. If the envelope does contain the correct mailing address, then the check and envelope shall be kept and maintained by ATC at its corporate offices for a period of nine (9) months. During the nine (9) month period, User may claim your Cash by writing to ATC Customer Service at 7378 West Atlantic Boulevard Margate, Florida 33053-4214. If the cash award is not claimed within the 9 month period, the award shall be permanently forfeited, at which time the Users name will be removed from the winner's list and the prize shall be dealt with as required by law.

By using the Site, you agree to indemnify and hold harmless ATC the Sponsors' and the Associated Parties (collectively, the "Indemnified Parties") from and against any and all litigation, demand, damages, suit, judgment, claim, liability, cause of action, action, proceeding, expenses, fees, attorneys' fees (including appellate level) and costs of any kind whatsoever brought by a third person (including, but not limited to, a federal or state regulatory agency) arising from your use of the Site, your registration, your participation in Offers, trial offers, all transactions, relationships or dealings between you and any and all Sponsors or as a result of the content of or any information you provide to the Indemnified Parties or your submission of ideas and/or related materials to the Indemnified Parties. The Terms and Policies and all transactions contemplated by the Terms and Policies shall be governed by, and construed and enforced in accordance with, the internal laws of the State of Florida without regard to principles of conflicts of laws. Any civil action or legal proceeding arising out of or relating to the Terms or Policies shall be brought in the courts of record of the State of Florida in Broward County or the United States District Court, Southern District of Florida. You consent to the jurisdiction of such Florida court in any such civil action or legal proceeding and waive any objection to the laying of venue of any such civil action or legal proceeding in such Florida court. You agree to comply with all laws that apply to the use of the Site.
